Is it always necessary to litigate a high net worth divorce?

High net worth divorces do not have to get resolved in a courtroom battle. As is the case with any Florida divorces, mediation or cooperative divorce are options.

To review, the cooperative divorce process requires the spouses to agree to an open exchange of information.  They and their attorneys will meet several times and, after reviewing the information, work together to resolve any issues with the couple’s finances or children in a way that makes the most sense.

The cooperative law process can work for South Florida couples with wealth

If a couple is invested in the process, cooperative law works for Fort Meyers residents in all sorts of financial situations. That said, either side is free to withdraw from the process so long as the couple has not finalized an agreement and submitted it to the court.

If the process breaks down, though, both sides will have to get new attorneys. Some in the legal community may refer to cooperative law as collaborative law.

If a couple is interested in cooperative divorce, they should not let the fact that they have considerable wealth or high incomes deter them. In fact, the process has an important advantage in that it is more private and can keep a high-profile couple’s sensitive personal and financial information out of the public eye.

The process could take longer simply because the couple’s finances are complicated, and even spouses with the best of intentions will want to be treated fairly. The couple and their attorneys may need to seek the help of financial experts whom they all respect as credible.

Also, it is worth pointing that cooperative divorce may not be the right tool for a couple if untreated mental illness, addiction or abuse are in the mix. Likewise, couples need to honestly ask themselves whether they will be able to set aside any hard feelings with each other in order to get the matter resolved.
